If the lower you already built has never had a rifle upper attached to it it's actually still legal to remove the CTR and replace it with a SBA3 to use as a pistol. If you buy a complete rifle or a stripped lower both of them fall on the government to prove. Which comes down to them being lucky to even likely prove. But it technically is against the law to take a rifle and turn it into a pistol.
